Availability of Access

SafeGuardID will notify participants, by posting notices on this site or by e-mail, of scheduled maintenance or upgrade work that may make the SafeGuardID Member Services section of this Web site unavailable for more than two hours. SafeGuardID does not warrant that the Member Services section of this Web site will be available on a continual 24-hour basis. The participant acknowledges that the traffic of data through the Internet may cause delays during the download of information from the SafeGuardID Member Services section of this Web site and shall not hold SafeGuardID liable for delays that are ordinary in the course of Internet use.

Intellectual Property Ownership

The participant recognizes that the entire content of the SafeGuardID Web site is SafeGuardID copyrighted and trademarked intellectual property. The participant shall not copy, republish, or distribute any copyrighted or trademarked material presented on the Web site, nor make any commercial use of the Web site or content of the Web site.

Choice of Law

This Agreement shall be construed and controlled by the laws of the state of Arizona. Any dispute concerning or breach of the terms of this Agreement will be governed by the laws of the state of Arizona.

1 Million Service Guarantee

The service guarantee provided by SafeGuardID is industry standard, limited, and in no way to be perceived as insurance against identity theft. We will pay up to $1,000,000 to correct the situtation.

Upon verification of a claim, we will assign a Customer Service Agent that will work with you through the resolution of your case. You will receive access to our toll-free dedicated Resolution Hot Line, so you can be quickly routed to your Customer Service Agent.

We will then bring in a 3rd party recovery expert to assess the facts of your case and determine the type and nature of the identity theft that has occurred.

The Recovery Specialist and your assigned SafeGuard ID Customer Service Agent will:

  • Consult with you.
  • Explain your rights as a victim.
  • Educate you on the recovery process.
  • Obtain additional information that is necessary to proceed with the recovery process.
  • Give you the pre-fill forms, and step-by-step instructions necessary for your state jurisdiction and type of identity theft.
  • Send over a Power of Attorney form that will allow them to act on your behalf during the recovery process.

Our $1 Million Total Service Guarantee does not cover: lost wages or business profits, loss of business or lost opportunities and direct out-of-pocket expenses like postage stamps, gas or mileage to go to local authorities, or any notary public fees, etc. The guarantee does cover the cost for lawyers, investigators, case managers but not any direct losses as a result of the theft. Under the Terms and Conditions, NO money passes directly to our SafeGuard ID members.

SafeGuardID shall not be responsible for the content of any Web sites to which this Web site provides links. This includes any and all affiliate website, landing pages, and blogs.

Warning: Misuse/Abuse Of Call Forwarding Number

Members agrees that they will faithfully utilize their designated call forwarding number (DID number) only in a manner as perscribed for it's use within the specific boundaries and instructions given by SafeGuard ID. If the call forwarding number is used in any other manner, our Inteligent Control System will disable the call forwarding number.

Entire Agreement/Modification

These Terms of Use constitute the entire agreement between SafeGuardID and the participant with respect to the participant's use of this Web site. This agreement supersedes any and all other agreements, either oral or written, between the participant and SafeGuardID with respect thereto. SafeGuardID may, from time to time and at its sole discretion, modify, amend, or otherwise alter the terms and conditions of these Terms of Use and the content of this Web site. The terms and conditions in effect at the time of the participant's use of this Web site shall govern such use.

Arbitration

The participant agrees to have any unresolved claim or dispute submitted to binding arbitration for resolution. Such arbitration shall take place in Phoenix, Arizona, and shall be conducted in accordance with the rules of the American Arbitration Association in effect at that time.
